Q: What are my rights in choosing my own representation?

As a claimant, you have the right to choose your preferred legal representation. However, the litigation funding agreement you signed with your previous law firm requires you to obtain written permission from the funder to move your case to a new law firm.


Q: What are the funder’s conditions for approving my new representation?

Your new law firm must agree to specific terms from the funder:

  • They must act in your best interests with skill, care, and diligence.
  • They must sign the funder's Solicitors Undertaking.
  • They must abide by the terms of your litigation funding agreement.
  • They must be authorised and regulated by the Solicitors Regulation Authority.
  • They must be a reputable firm with appropriate staffing levels.

Q: I have already found a new law firm. What should I do?

Please inform us of the law firm you wish to use so we can discuss funder approval with them directly.


Q: Can you help me choose a new law firm?

There is a panel of pre-approved law firms that we can move your case to with your authorisation.


Q: Can you send me a copy of the documents?

We are in the process of launching a 'claimant portal' where you can manage your case and access documents securely. This portal is expected to go live in November.


Q: I don’t want to proceed anymore. What happens now?

If you wish to cancel, there may be financial penalties due to the costs already incurred under your litigation funding agreement. You have agreed to fully cooperate with the progression of your case under the terms of the agreement.


Q: Is my case still on a no win no fee basis?

Yes, your case remains on a no win no fee basis under the conditional fee agreement you signed with your law firm. The next law firm will also operate on the same basis.


The litigation funding is non-recourse, meaning if your case is unsuccessful, you do not have to pay anything. The funding includes insurance to cover costs if the case loses.
